Terms of Service

These Terms govern your use of Qlaudia (the "Service"), operated by Charles Irvine Enterprises LLC ("Qlaudia", "we", "us"). By creating an account or using the Service you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Service.
1. Eligibility
You must be at least 13 years old to use the Service. If you are under 13, you may not create an account or use the Service. If you are under the age of majority where you live, you may use the Service only with the consent and supervision of a parent or legal guardian, who agrees to these Terms on your behalf. We do not knowingly collect personal information from children under 13.
2. Your account
You are responsible for your account credentials and for activity under your account. Provide accurate information and tell us promptly of any unauthorized use. Accounts are personal and may not be shared or sold.
3. What the Service is
Qlaudia provides AI-generated courses, concept explanations, quizzes, figures, and an AI chat assistant. All course content is generated by artificial intelligence. Courses may be published, and in some cases reviewed, by third-party subject-matter experts ("School Publishers") and course authors, but review by a person does not make the content error-free.
4. Educational use only; no professional advice
Content is for general educational purposes. It is not medical, legal, financial, or other professional advice, and it is not a substitute for a qualified professional. Do not rely on the Service for health or safety decisions, including decisions about any medical condition or treatment. Always consult a qualified professional.
5. AI-generated content
All course content on the Service, including explanations, quizzes, answers, and figures, is generated by AI and is subject to the errors and limitations of large language models. It may contain errors, omissions, outdated or fabricated information, and incorrect or misattributed facts, even when it appears authoritative. Courses are never guaranteed to be accurate, complete, or suitable for any particular purpose. Verify anything important with a reliable source. Quiz results and progress indicators are informational and are not certifications, grades, or official records of attainment.
6. Acceptable use
You agree not to: (a) break the law or infringe others' rights, or impersonate any person or entity or misrepresent your identity or affiliation; (b) attempt to access other users' data or probe, disrupt, or overload the Service; (c) scrape, bulk-download, or use the Service or its content to train machine-learning models; (d) circumvent access controls or usage limits; (e) submit unlawful, harassing, or harmful content to the chat or feedback features; (f) resell or redistribute the Service or its content without permission.
7. Your content
You keep ownership of what you submit (chat messages, feedback, answers). You grant us a non-exclusive, worldwide, royalty-free license to host, process, and use it to operate, secure, and improve the Service. We do not sell your personal information.
8. Our content and intellectual property
The Service, its software, and its content (other than your content and content owned by School Publishers) belong to Qlaudia or its licensors. We grant you a limited, revocable, non-transferable license to access and use the Service and its content for your own personal, non-commercial learning.
9. School Publishers and third-party content
School Publishers and course authors are independent. Their views are theirs, not ours. Courses published under their names are provided "as is": neither they nor we make any warranty about the accuracy or completeness of course content, and we do not guarantee any School Publisher's or author's qualifications.
10. Third-party services
The Service relies on third-party providers, including authentication, hosting, database, and AI providers (see the Privacy Policy). Their availability and terms may affect the Service.
11. Payments
The Service is currently free. If we introduce paid features, additional terms covering pricing, billing, and refunds will be presented before you purchase.
12. Termination
You may stop using the Service and delete your account at any time. We may suspend or terminate access if you violate these Terms or if needed to protect the Service or other users. Sections that by nature should survive termination (including 4, 5, 7, 8, 13–16) will survive.
13. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT CONTENT WILL BE ACCURATE OR COMPLETE.
14. Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, QLAUDIA, SCHOOL PUBLISHERS, COURSE AUTHORS, AND THEIR OFFICERS, DIRECTORS, EMPLOYEES, CONTRIBUTORS, AFFILIATES, AND PARTNERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR LOSS OF DATA, PROFITS, OR GOODWILL. THE TOTAL LIABILITY OF ALL OF THEM, COMBINED, FOR ANY CLAIM RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM OR US$100. TO THE FULLEST EXTENT PERMITTED BY LAW, YOU RELEASE QLAUDIA, SCHOOL PUBLISHERS, AND COURSE AUTHORS FROM ALL CLAIMS, DEMANDS, AND DAMAGES OF ANY KIND ARISING FROM ERRORS, OMISSIONS, OR INACCURACIES IN COURSE CONTENT OR OTHER AI-GENERATED CONTENT, OR FROM YOUR RELIANCE ON IT. Nothing in these Terms excludes liability that cannot be excluded by law, such as liability for fraud. Some jurisdictions do not allow certain limits or releases, so parts of this section may not apply to you.
15. Indemnity
You agree to indemnify Qlaudia against claims arising from your violation of these Terms or misuse of the Service, to the extent permitted by law.
16. Governing law and disputes
These Terms are governed by the laws of the State of Missouri, without regard to conflict-of-law rules. Disputes will be resolved in the courts of Platte County, Missouri, unless otherwise required by law.
17. Changes
We may update these Terms. For material changes we will ask you to accept the new version before continuing to use the Service. Continued use after a non-material change means you accept it.
